"It is understandable. Like most professionals who are elevated to administrative positions, the CJ is busy attending to administrative work. He is bogged down with such work," he added.
Nazri’s reply, however, did not go down well with Kulasegaran who said: "This is perverse logic.
"The basic rule of his job is to be a judge… to the judiciary. Every CJ in the past has held the post and at the same time provided landmark judgments."Nazri told Kulasegaran to accept his answer as to why the chief justice could not write a judgment.
"You can’t use the benchmark of 20 years ago for today. The situation has changed. I am the de facto law minister and that is the answer I can offer. I am not here to protect him," he said.
Kulasegaran, in debating the bill, said the present chief justice had been too busy travelling overseas to the point that there was no decision on the much talked-about Lina Joy case.
"That is what the legal fraternity is saying. He is too busy travelling rather than doing his job. He should not be spending time going overseas to see how the courts in China or Sweden operate," he said.
Kulasegaran also criticised the chief justice for being absent when the king delivered his the royal address in March.
"I think this is the first time in 50 years that the CJ did not attend the royal address. How can this be?" he asked.
Nazri replied that the chief justice was not present as he was away attending a conference for magistrates in Sabah.
